Acceptance of Terms
By accessing or using Avgeek, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the application. Please read through the following list of items to learn more about the service terms for application usage. We'll communicate to your registered email address in case these terms change in advance.
1. Eligibility
You must be at least 13 years old and capable of entering into a binding agreement to use the application.
2. User Accounts
2.1 Account responsibilities
- Provide accurate, current, and complete information.
- Maintain the confidentiality of your credentials.
- Do not share your account access with others.
- Notify us immediately at support@avgeek.io if you suspect unauthorized access.
- Accept responsibility for activities that occur under your account.
2.2 Account termination
You may terminate your account through the App settings or by contacting support@avgeek.io. We may suspend or terminate accounts that violate these Terms or threaten the integrity of the Services.
3. The Services
3.1 Flight tracking and management
Avgeek offers flight search, real-time status updates, trip organization, statistics, and related aviation features using data from third-party providers.
3.2 Data accuracy
Flight information may contain delays, omissions, or inaccuracies. Do not rely solely on Avgeek for time-critical travel decisions.
3.3 Availability
We aim to keep the Services available, but we do not guarantee uninterrupted or error-free access.
4. Subscriptions and Payments
4.1 Plans
Avgeek offers a free tier and paid Pro subscriptions, including monthly, yearly, and lifetime options.
4.2 Billing
- All fees are charged in USD unless stated otherwise.
- Payments are processed through Stripe, Apple App Store, Google Play Store.
- Prices may change, and subscribers will be notified when required.
- Taxes may apply depending on your jurisdiction.
4.3 Renewal and refunds
Monthly and yearly plans renew automatically unless canceled before renewal. Refund requests are handled under our Refund Policy and any applicable payment platform rules.
5. Acceptable Use
The App is provided for personal use in compliance with law.
- Attempt unauthorized access to the App, accounts, or connected systems.
- Reverse engineer, decompile, or attempt to derive source code.
- Use automated tools to scrape, data mine, or access the App in unauthorized ways.
- Interfere with the App or connected networks.
- Use the App for illegal, fraudulent, or abusive activity.
- Impersonate another person or entity.
- Transmit malware or harmful code.
- Resell, rent, or sublicense access to the App.
- Reverse engineer or attempt to extract source code
- Use automated systems to scrape or data mine
- Resell or redistribute the App or its content
- Abuse flight data provider integrations
6. Intellectual Property
6.1 Our materials
The App and its content, features, and functionality are owned by Avgeek, Inc. and protected by applicable intellectual property laws.
6.2 Your content and feedback
You retain ownership of content you submit, but you grant us the rights necessary to operate and improve the Services. Feedback you share may be used by us without restriction or compensation.
7. Third-Party Services
The App integrates with third-party providers for aviation data, weather, payments, and authentication. Their services are governed by their own terms and privacy policies.
8. Disclaimers
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied.
- The App will be uninterrupted, secure, or error-free.
- Flight data will be accurate, complete, or timely.
- Results obtained through the App will meet your expectations.
- Automated check-in will always succeed.
9. Limitation of Liability
To the maximum extent permitted by law, Avgeek, Inc. is not liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the App.
Our total liability will not exceed the greater of the amount you paid to us in the twelve months preceding the claim or $100.
10. Indemnification
You agree to indemnify and hold harmless Avgeek, Inc. from claims, damages, liabilities, losses, and expenses arising out of your use of the App, your violation of these Terms, or your infringement of any rights.
11. Governing Law and Disputes
These Terms are governed by the laws of State of Delaware. Disputes will be resolved through binding arbitration unless otherwise required by law.
